1. Acceptance of Terms
By accessing or using MedViva's website (medviva.org) or intake and guidance services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use our services.
These Terms constitute a legally binding agreement between you and MedViva, Inc. We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
2. Eligibility
To use MedViva's services, you must:
• Be 18 years of age or older
• Be a resident of a US state where MedViva operates (currently 49 states)
• Provide accurate and complete health information during your intake
• Not be seeking services for any illegal purpose
By using our services, you represent that you meet these eligibility requirements.
3. Nature of Services
MedViva is an online intake and guidance platform that facilitates connections between individuals and independent, licensed healthcare providers.
MedViva does not practice medicine. The physicians on our platform are independent contractors, not employees of MedViva. The physician-patient relationship is between you and the treating physician.
A prescription is not guaranteed. Your case will be reviewed by a licensed physician who may decline to prescribe if they determine the requested treatment is not appropriate for you. You will not be charged if a prescription is not issued.
4. Payment and Fees
MedViva charges a non-refundable service fee for its platform services.
• The service fee is a one-time charge for information processing and next-step guidance
• This fee is non-refundable once your intake has been reviewed
• No recurring charges or subscriptions are applied without your explicit consent
• This fee is not a payment for medical services, prescriptions, or medication
• We accept major credit/debit cards and HSA/FSA cards where eligible
If you have a billing question, contact support@medviva.org within 48 hours of payment.
5. Medical Disclaimer
The information provided on medviva.org, including articles, FAQs, and treatment descriptions, is for general informational purposes only and does not constitute medical advice.
Do not delay seeking professional medical advice because of information you read on this website. If you are experiencing a medical emergency, call 911 or your local emergency number immediately.
MedViva's intake and guidance services are not appropriate for emergency situations or acute conditions requiring in-person evaluation.
6. User Responsibilities
You agree to:
• Provide accurate and truthful health information at all times
• Notify your care team of any changes to your health status or medications
• Use prescribed medications only as directed by your physician
• Not share your account credentials with others
• Immediately notify us of any unauthorized access to your account
You are solely responsible for the accuracy of information you provide. Providing false or misleading health information may result in improper prescribing and serious health consequences.
7. Intellectual Property
All content on medviva.org — including text, graphics, logos, and software — is the property of MedViva, Inc. and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any content without written permission.
8. Limitation of Liability
To the fullest extent permitted by law, MedViva, its officers, directors, employees, and affiliated physicians shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.
Our total liability in connection with these Terms shall not exceed the amount you paid to MedViva in the 3 months preceding the claim.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Delaware. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive relief in court.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
